Terms of Use

These terms apply to the Strip series of plugins for Stream Deck (each a “plugin”), including AgendaStrip, provided by k-five LLC (“we” or “us”). By installing or using a plugin, you agree to these terms. Additional terms for a specific plugin, if any, are shown on that plugin’s page.

1. License

We grant you a personal, non-exclusive, non-transferable license to install and use each plugin you have obtained through the Elgato Marketplace, on devices you own or control, in accordance with these terms. We and our licensors keep all rights in the plugins that are not expressly granted to you.

2. Purchases and refunds

Plugins are obtained through the Elgato Marketplace. Purchases, payment, and refunds are handled under the terms of the Elgato Marketplace.

3. Calendar and other services

Some plugins connect to services provided by others, such as Google, Microsoft, and Apple. Your use of those services is governed by your agreements with their providers. You are responsible for having the accounts and permissions needed to use them. We do not provide user accounts of our own.

4. What you must not do

You must not:

• copy, modify, distribute, sell, or sublicense a plugin, except as allowed by law or by these terms;
• reverse engineer, decompile, or disassemble a plugin, except to the extent that applicable law expressly permits it;
• use a plugin in a way that breaks the law or the terms of the services it connects to, or that interferes with those services.

5. Changes and availability

We may update, change, or stop providing a plugin or a feature. A plugin depends on the Stream Deck app and on the services it connects to, which may change without notice from us.

6. Disclaimer

We provide the plugins “as is”. To the extent permitted by applicable law, we do not warrant that a plugin will be free of errors or will meet your particular needs. For example, a plugin shows information it receives from calendar services; please check important events in your calendar itself.

7. Limitation of liability

We are liable for damage caused by our intent or gross negligence. If we cause damage through ordinary (slight) negligence, our total liability is limited to the amount you paid for the plugin concerned, except where applicable law does not allow such a limitation. Nothing in these terms limits any rights you have under consumer protection laws that cannot be excluded or limited by agreement.

8. Consumers outside Japan

If you are a consumer living outside Japan, mandatory consumer protection laws of your country of residence may also apply to you, and nothing in these terms takes those protections away.

9. Changes to these terms

We may change these terms. When we do, we will update the “Last updated” date on this page and keep the previous version at a dated URL linked from this page. Changes do not apply to periods before they take effect.

10. Governing law and jurisdiction

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute arising from or relating to these terms or your use of the plugins, subject to section 8.
